Bad guys win good guys lose, why?

Why is it that in action films an example being Batman that for the majority of the movie etc the bad guy is always on top that is to say he is always winning. It is true that to win you must first have lost a battle but it seems consistent that even though the good guy might accomplish the thing he set out to do he never gets a chance to extract revenge.

Take Batman for instance he said he was not a good guy but not a bad guy so that makes him a  imbetweener he said that himself if that's the case he's not a good guy why did he not finish 'the Joker' of? 

Bad guys always seem to win because their tactics are more thought out than those on the side of good. The idea's of the good are spontaneous. 

To be a good guy there is always a set of rules that you must obey, a example perhaps?

. Always accept the surrender of the villain and do not harm them in any way. 

. Never beat anyone despite your personal feelings. 

. Never cause problems when there is a risk of a bystander being hurt. 

. Never subject your counterpart to torture.

I'm going to go back to Batman again and point out some examples. I believe it was 'the Joker' who said that if your a good guy you obey rules being a bad guy you can do whatever whenever never caring. 

I would love to see a TV programme, film, book etc whatever have the good guy lose once as he must but after that let the good guy win let the good guy destroy the bad. 

I think that, that would be a really good TV watch film watch because no one wants to see a film of pure evil.
